Background
CAIVAN (Perth GC) Limited submitted a Planning application, which was deemed complete on May 8, 2023. A Public Meeting was held on Aug. 10, 2023, and comments were received from agencies and the public at that time.
Notice was received in September 2023 that CAIVAN had submitted an appeal to the Ontario Land Tribunal (OLT) regarding the Zoning By-law Amendment and Plan of Subdivision.
To date, four Case Management Conferences (CMC) have been held. The OLT initially granted the request to adjourn the merit hearing originally scheduled to begin on Aug. 19, 2024. The adjournment was agreed to by all parties to allow the developer time to obtain the information necessary to evaluate the proposal. The Merit Hearing was rescheduled to take place from Monday, Feb. 10, 2025, to Friday, Feb. 28, 2025. On Jan. 7, 2025, the OLT granted a request to adjourn the Merit Hearing, replacing it with a Tribunal-led mediation to take place on Feb. 10, 2025, as requested by CAIVAN and agreed to by all parties.
A revised concept plan was submitted by CAIVAN on March 1, 2024. Town staff met with representatives from Lanark County and the Rideau Valley Conservation Authority (RVCA) to discuss the implications of the revisions. We are actively exploring avenues to continue working towards mediation with all involved parties.
As the matter is one of a legal capacity, Town staff and Council are not able to make public comment. Furthermore, Town staff and Council no longer have the ability to make a final decision on the subject as a result of the appeal; this decision will be made by the Province through the OLT.
